The eight pieces constituting this Meeting Report are summaries of presentations made during a panel session at the 2011 Association for Practical and Professional Ethics (APPE) annual meeting held between March 3rd and 6th in Cincinnati. Lisa Newton organized the session and served as chair. The panel of eight consisted both of pioneers in the field and more recent arrivals. It covered a range of topics from how the field has developed to where it should be going, from identification of (...) issues needing further study to problems of training the next generation of engineers and engineering-ethics scholars. Since at least the mid-1970s, public health and law enforcement officials have conducted joint or parallel investigations of both health problems possibly associated with criminal intent and crimes having particular health dimensions. However, the anthrax and other terrorist attacks of fall 2001 have dramatically underscored the needs that public health and law enforcement officials have for a clear understanding of the goals and methods each discipline uses in investigating such problems, including and especially the potential use of biologic agents as (...) weapons of mass destruction. Recognition of these needs has prompted some experts to call for the application of “forensic epidemiology” to such problems. Even before the attacks of fall 2001, other problems, such as the detection of the West Nile Virus in the United States and concerns that the emergence of this infectious agent was the consequence of a deliberate act, raised novel challenges to the combined interests of public health and criminal investigators. Women who had had breast cancer and had been enrolled in a large genetic breast cancer epidemiological study were interviewed about their experience of participation in the study, their attitudes to the confidentiality of data, and the feedback of personal and general research results. Collection of family history information seemed more salient in indicating the genetic nature of the study than the enrolment information sheet. There were no concerns about confidentiality.While participants would have welcomed general feedback about the results of (...) the study and were critical that this had not been provided, the feedback of personal information proved complicated and, sometimes, difficult. It is suggested that individual feedback of genetic test information in epidemiological studies should be undertaken only when there are specific reasons. (shrink)

This article re-visits the critiques of anthropocentricism levied against John Dewey by his contemporaries and offers a reading of this critique through the lens of nonhuman agency using the theoretical work of Bruno Latour and Jane Bennett, particularly the latter’s coverage of Dewey’s theory of democracy. This work culminates into an argument for envisioning Dewey’s publics as constituted by human and nonhuman bodies, anticipating in some ways the work of contemporary posthumanists and new materialists. This leads us to not only (...) re-think Dewey’s typecasting as unabashedly anthropocentric but also reinvigorates the use value of Dewey’s thinking in the context of contemporary ecological issues. Perceptual completion fills the gap for discrete perception to become continuous. Similarly, dynamic perceptual completion provides an experience of dynamic continuity. Our recent discovery of the ‘happening’ element of DPC completes the total experience for dynamism in the flow of time. However, a phenomenological explanation for these experiences is essential. The Snapshot Hypotheses especially the Dynamic Snapshot View provides the most comprehensive explanation. From that understanding the ‘two times’ problem can be addressed. The static time of spacetime cosmologies has been (...) irreconcilable with the dynamic FOT. Dismissing the FOT as an illusion is unsatisfactory. Therefore, we provide four hypotheses for the TTP.1) Since cosmological static time demands that all events are discrete, DPC elements for dynamism should likewise be expected to be discrete and accounted for by a snapshot phenomenology such as the DSV. 2) If temporality can be demonstrated to be similar to apparent motion by being a snapshot phenomenon and not demanding temporal extension it would confirm the DSV and permit reconciliation with static time. 3) If the ‘present moment’ is subjective as static time theories suggest, it should be possible experimentally for an observer to choose his own ‘present’ by moving to various points in the past with the aid of virtual reality. 4) If dynamism e.g. motion can be precluded without significant information loss or violating physics principles it is a cognitive add-on, thereby contradicting non-static time theories which suggest that time is ‘real.’ We confirm those hypotheses. A possible solution is offered to help resolve the “two times problem” regarding the veridical and illusory nature of time. First it is recognized that the flow (passage) of time is part of a wider array of temporal experiences referred to as manifest time, all of which need to be reconciled. Then, an information gathering and utilizing system (IGUS) model is used as a basis for a view of manifest time. The model IGUS robot of Hartle that solves the “unique (...) present” debate is enhanced with veridical and (corresponding) illusory components of not only the flow of time but also the larger entity of manifest time, providing a dualistic IGUS robot that represents all of the important temporal experiences. Based upon a variety of prior experiments, that view suggests that the veridical system is a reflection of accepted spacetime cosmologies and through natural selection begets the illusory system for functional purposes. Thus, there are not two opposing times, one outside and one inside the cranium. There is just one fundamental physical time which the brain developed, now possesses and is itself sufficient for adaption but then enhances. The illusory system is intended to provide a more satisfying experience of physical time, and better adaptive behavior. Future experiments to verify that view are provided. With a complete veridical system of temporal experiences there may be less need to reify certain temporal experiences so that the two times problem is less of a problem and more of a phenomenon. Elephants show a rich social organization and display a number of unusual traits. In this paper, we analyse reports collected over a thirty-five year period, describing behaviour that has the potential to reveal signs of empathic understanding. These include coalition formation, the offering of protection and comfort to others, retrieving and 'babysitting' calves, aiding individuals that would otherwise have difficulty in moving, and removing foreign objects attached to others. These records demonstrate that an elephant is capable of diagnosing animacy and (...) goal directedness, and is able to understand the physical competence, emotional state and intentions of others, when they differ from its own. We argue that an empathic understanding of others is the simplest explanation of these abilities, and discuss reasons why elephants appear to show empathy more than other non-primate species. One of the most dominant approaches to semantics for relevant (and many paraconsistent) logics is the Routley-Meyer semantics involving a ternary relation on points. To some (many?), this ternary relation has seemed like a technical trick devoid of an intuitively appealing philosophical story that connects it up with conditionality in general. In this paper, we respond to this worry by providing three different philosophical accounts of the ternary relation that correspond to three conceptions of conditionality. McCormick (bio)IntroductionAlthough widely used by scientists, the term "preembryo" has raised some suspicions. Histopathologist Michael Jarmulowicz (1990), for example, asserts that the term was adopted by the American Fertility Society (AFS) and the Voluntary Licensing Authority (VLA) in Britain "as an exercise of linguistic engineering to make human embryo research more palatable to the general public."I cannot speak for the (...) VLA, but I can clarify that this was not the motive of the AFS. As a member of the AFS ethics committee that discussed and adopted this terminology, I know that our discussion was not tied to embryo research or moral issues. The term "preembryo" was adopted because the earliest stages of mammalian development primarily involve establishment of the nonembryonic trophoblast, rather than the formation of the embryo. As Clifford Grobstein (1988, p. 61), a distinguished basic scientist who also sat on the AFS committee notes:The scientific rationale for the term preembryo... is its greater accuracy in characterizing the initial phase of mammalian and human development.... The status implications of such a change in terminology were not at issue in the discussion.This is not to say that the moral status of the preembryo is not a concern worthy of independent consideration. It is an important question with significant practical implications, especially in the context of in vitro fertilization. At stake are issues such as: (1) what may be done to preembryos before transfer; (2) whether all preembryos must be transferred; and (3) what may be done to preembryos that are not transferred (Ethics Committee of the American Fertility Society (AFS) 1986, p. 29S). Furthermore, emergency treatment of rape cases may also depend on such a determination. [End Page 1]Cryopreservation, which entails freezing unused preembryos for possible later use, is one example of a procedure that raises issues associated with the moral status of the preembryo. Cryopreservation decreases the number of stimulated egg recovery cycles a woman must undergo and increases flexibility in transfer protocols. But thawing of the preembryos is not a completely benign process; significant numbers of the preembryos die in the process and injury cannot be excluded.In addition, down the road a year or so lies preimplantation genetic diagnosis, now being tested in several centers of reproductive research. This would involve the removal of one or more cells from a preembryo developing in vitro. The DNA from these cells would be studied and then only genetically normal preembryos would be transferred. With the growth in knowledge about single gene defects and the rapid advance of amplification technology, which allows gene visualization, it is not difficult to imagine scientists embarking on a variety of micromanipulations of the preembryo for the sake of gaining knowledge.Not all research with gametes involves preembryos, but clearly some experiments and procedures await resolution of the moral status of the preembryo. I contend in this paper that the moral status—and specifically the controversial issue of personhood—is related to attainment of developmental individuality (being the source of one individual). This contrasts with the view that holds that personhood occurs earlier, at the point of genetic uniqueness. I believe that an embryo that has developed to the point where it can be one individual and one individual only, differs in moral status from a preembryo that has not, even if in many cases we may choose to treat them similarly.The Scientific UnderpinningsTwo things must be kept in mind—and in a sense, in tension—in turning to science for help in assessing the status of the preembryo. First, science is not competent to decide the question of personhood or ensoulment. There is a long standing debate as to whether or not time is ‘real’ or illusory, and whether or not human time is a direct reflection of physical time. Differing spacetime cosmologies have opposing views. Exactly what human time entails has, in our opinion, led to the failure to resolve this ‘two times’ problem. To help resolve this issue we propose a dualistic model of human time in which each component has both an illusory and non-illusory aspect. With the dualistic (...) model we are able to provide experimental tests for all of the human time assertions of 10 chosen spacetime cosmologies. The illusory aspect of the ‘present,’ i.e. a ‘unique present’ was confirmed. An information gathering and utilizing system was constructed using a virtual reality apparatus allowing the observer to experientially roam back and forth along the worldline ad lib. The phenomenon of ‘change’ was experimentally found to be illusory at high frequency observation and non-illusory at low frequency observation, the latter phenomenon coinciding with ‘change’ referred to in the ‘Order of Time’ and ‘Relativity Refounded’ views. Additional experiments are presented indicating that both motion and temporality are dualistic. In sum, the dualistic model of human time allows for the existence of both illusory and non-illusory aspects of human time that are not in conflict with one another. The mind-body problem has a long history that begins well before Descartes made it extreme by presenting mind as unextended active thinking and (...) matter as unthinking passive extension. This absolute division was motivated in some part by the desire to present the soul as an entity that can survive the death of the body. This is difficult to maintain if the soul is merely the form or the vital force motivating a human body. But the advance of physiology has led more and more to the conclusion that the functions often attributed to the soul are actually carried out by the brain. Thinking may be as natural (and perhaps as determined) a function of the body as is digestion. And if digestion does not survive the death of the body, maybe thinking does not either.This collection of studies provides a detailed introduction to both medical and metaphysical views and theories concerning the relation of mind to body. In particular, the first article by Beate Gundert on Hippocratic Medicine sets the stage by showing that "mind and body in the Hippocratic writings, while distinguished empirically by being related to different types of phenomena, are both ultimately accounted for by the same explanatory model: Human nature (physis), which embraces the totality of bodily structures, physiological processes, and psychic events" (35). T. M. Robinson shows that Plato admits of no solution as to how mind and body interact, and Philip J. van der Eijk argues that "to detach the essence of man completely from his physical make-up would run counter to Aristotle's biological approach to man as a natural living being, the ultimate implication of his view on the divinity of nous is that the fullest realization of what it is to be a human being is to go beyond the limits of corporeality and mortality, and to become, if only temporarily, a god" (77). Heinrich von Staden covers Epicurus, Herophilus, Erasistratus, the Stoics, and Galen, concluding that "The discovery of the nerves entailed the first significant erosion of the vast territory ruled by the soul in Platonic and Aristotelian philosophy, an erosion accompanied by an expansion of the rule of 'nature,' visible not only in medicine, but also in philosophy" (116). Theo K. Heckel discusses Saint Paul's insistence upon the whole person, and Gareth Matthews shows that, prior to Descartes, Augustine presents "a radically new argument for mind-body dualism... an internalist argument... that proceeds from what, allegedly, the mind can know concerning itself to the conclusion that the mind is incorporeal" (145). Emily Michael discusses Pomponazzi's view that we know the immortality of the soul only by faith and the scholastic attempts to show that the soul is a substantial form. (bio)The general struggle throughout Christian history has been to seek the proper balance between dominion and limits, intervention and nonintervention, givenness, and creativity. This struggle has worked itself out in six areas that touch human life. In this essay, I will revisit the Catholic tradition’s treatment of these in terms of dominion and limits to see whether we can discern developmental (...) patterns that might suggest an approach to issues pertaining to the sources of life (reproductive ethics) as we move into the next century.1. Abortion. The history of the treatment of abortion in the Catholic tradition is the history of an evaluation. This evaluation was somewhat muddied by [End Page 387] unclarity and inconsistency in the use of terms. Thus, some theologians distinguished three types of abortion: prevention of conception, abortion of an inanimate fetus, and abortion of an animated fetus. Others regarded all interventions into the life-giving process as homicides. Still others argued that termination of a nonanimated fetus was justified to save the life of the mother. And still others said such termination was anticipated homicide or the misuse of semen conceptum.Such unclarities and qualifications eventually vanished and produced an evaluation of fetal life that yielded to very few competing interests, what John Noonan (1970) referred to as “an almost absolute value.” There was some dominion or control, but the limits became increasingly clear and powerful.2. Individual and corporate self-defense. Augustine disallowed lethal individual or personal self-defense, but established the first elementary rules for war. Aquinas allowed both. Vitoria, Suarez, and others refined the criteria justifying war (jus ad bellum) and listed them as three: recovery of property, resistance to aggression, and vindication of injuries (injustices). Pius XII narrowed these to a single reason: national self-defense. The Challenge of Peace (NCCB 1983) moves away from the licitness of nuclear war and nuclear deterrence even for self-defense. Once again, the limits to the dominion over life in war grow stronger and more powerful even as the weapons of such dominion grow more powerful.3. Capital punishment. Over the centuries, Christian thinkers, such as Thomas Aquinas, permitted the use of capital punishment. Three justifications were proposed to found this right of the state: retribution, deterrence, and reform. In the past decades, however, these justifications have been seriously questioned. Both the American and Philippine bishops’ conferences have rejected all use of capital punishment. Most recently John Paul II (1995, n. 56, p. 709) adduces defense of society as the only possible justification for it and sees such cases as “very rare if not practically non-existent.”4. The preservation of life. The theme of a balance between dominion and limits is perhaps nowhere clearer than in the Catholic approach to life preservation. Catholic tradition does not accept our culture’s rejection of death. Rather it asserts that the facts that we are pilgrims, that Christ has overcome death and lives, and that we also will live with him yield a general value judgment on the meaning and value of life as we now live it: Life is a basic good but not an absolute one. It is basic because, as the Congregation for the Doctrine of the Faith (1980, p. 511) worded it, it is the “necessary source and condition of every human activity and of all society.” It is not absolute because there are higher goods for which life can be sacrificed—e.g., the glory of God, salvation of souls, service of one’s brethren, and the like. Thus in John (15:13): “There is no greater love than this: to lay down one’s life for one’s friends. The purpose of this study was to determine if an instrument could be developed to measure spiritual engagement. The study resulted in the Spiritual Engagement Instrument concept comprised of four factors that included the following: worship that explained 57.8% of the variance and Cronbach’s alpha of.94, meditation that explained 12.7% of the variance and Cronbach’s alpha of.96, fasting that explained 9.58% of the variance and Cronbach’s Alpha of.98, and rest that explained 5.16% of the variance and Cronbach’s alpha of.99. The (...) four factors together explain 85.24% of the variance. The four spiritual engagement scales within the Spiritual Engagement Instrument show significant correlation with other similar but different measures of spirituality, the Brief Multidimensional Measure of Religiousness/spirituality scale and Daily Spiritual Experience Scale, confirming convergent validity. A supplemental validation study was performed using CFA, p <.001, CFI =.98, TLI =.97, RMSEA =.06). This SpEI offers researchers a tool that might be used as a pre-/post-test measure in conjunction with a spiritual development program or to measure effects of the four factors of spiritual engagement with other social constructs such as job satisfaction, normative commitment, or leadership behaviors. Ethical behavior may be influenced by individual worldview and underlying religious practices, so the SpEI offers a validated instrument to study the cycle of behaviors, attitudes, and beliefs of spiritual practices that may influence ethics. "They didn't just want to keep the conversation going; they wanted to get to a better place" (p. 440). So much for the most prominent contemporary pragmatist, Richard Rorty, who remains unmentioned except in the (...) acknowledgments. That better place is participatory democracy (a phrase that does not appear in the book), which "means that everyone is equally in the game, but it also means that no one can opt out" (p. 441). The true name of the game is skeptical tolerance. There are no unquestionable duties or inalienable rights, no immutable natural laws, no absolute moral rules, no highest principles, no inherent virtues, no absolute standards, no stasis, no absolutely certain truth. There are no individual destinies, because the social comes before the individual, and the individual is embedded within and cannot exist without society. Scientific knowledge is always probabilistic, not necessarily because nature is indeterministic, but because we can never know enough to calculate its regularities if they exist. To wit, there are no Platonic Ideas or unchanging universals. All is change, nothing that happens is ever repeated, our general ideas and laws of nature are merely tools for getting along in the world. Above all, ideas do not refer to things, only to other ideas. What expedites our thinking is true. What expedites our acting is right. Whenever we act according to principle, rule, or law, we are making a bet that events will turn out the way [End Page 353] we think they will. If we keep this always in mind, we will never succumb to violence or war in the name of belief or principle. Whatever we believe, it could be otherwise. Such is a general summary of pragmatism as it has filtered down to the textbooks. It is (again befittingly) more or less accurate. The can-do American seeks out cash value in practical life.Oliver Wendell Holmes, Jr., William James, Charles Saunders Pierce, and John Dewey crafted the only indigenous philosophy that has so far been produced in America. Its roots are in Laplacean probability theory, Darwinian evolutionism, and Chauncey Wright's indeterminism. While James hoped to save a place for religion (if it works, go with it) and Pierce a place for God (he thought there had to be a designing intelligence to account for order), the pragmatic result is profoundly skeptical and secular. Neither Holmes nor Dewey thought that individuals imbedded in societies had any need of absolutes. Holmes said that people first decide on the basis of experience, then they deduce. Dewey said that people first behave commonsensically, then they rationalize.There is nothing as condensed as the above in Louis Menand's beautiful book on the ideas, personalities, and influence of Holmes, James, Pierce, and Dewey. I know of no clearer exposition of their ideas, and few biographers have made them come so alive. In particular, Menand's coverage of peripheral (but by no means insignificant) figures is very rich. He describes the development of graduate universities in America in detail from their autocratic beginnings to the institution of academic freedom as we know it today. University presidents, trustees, and administrators are presented luxuriously as the villains, and the professors gloriously as the heroes. Menand remarks with slight amazement that society bought the concept that professors were beholden to the public at large and not to the state or private university owners. He could have commented further on the fact that the concept of academic freedom has become virtually irrelevant in today's corporate research universities."It is a remarkable fact about the United States," Menand begins his book, "that it fought a civil war without undergoing a change in its form of government" (p. ix). Although there is plenty of both academic and journalistic writing about literature, less and less is well described by the term "literary criticism." The literary critics of the first two-thirds or so (...) of the twentieth century, now dead, including poets and other creative writers, such as T. S. Eliot, journalists such as Edmund Wilson, and academic literary critics, as distinct from literary scholars, such as F. R. Leavis in England and Cleanth Brooks in the United States, have so few successors that the very genre, if not yet dead, is moribund.1 McDonald deplores the decline of literary criticism and seeks to explain its causes.In place of literary criticism, McDonald (and many others, such as John Ellis) argue, we have postmodern literary theory, an animal of quite a different color from literary criticism.2 "Texts... are interpreted and analysed with a view to unlocking the social norms and attitudes encoded therein, not assessed or evaluated as integral, self-contained creations" (McDonald, p. 21). After all, most literary teachers are not postmodernists. What has happened is the professionalization, in not altogether a good sense, of literary studies. Let me illustrate. More than half a century ago, Cleanth Brooks published what became a famous book of literary criticism, consisting of close readings of famous poems.5 The New Critics were much taken with the metaphysical poets, the most prominent of whom was John Donne, and the high point of Brooks's book was his brilliant close reading of "Canonization," one of Donne's most famous love poems. Just this year (2008) a professor of literature named Ramie Targoff published John Donne, Soul and Body, which has an extensive treatment of Donne's love poetry, though it does not mention "Canonization." As far as I can judge, Targoff's book is a fine scholarly achievement—well written (and not defaced by jargon), thoroughly researched, thoughtful, imaginative. She argues that contrary to some scholars who have regarded Donne as a Neoplatonist who therefore believed that the highest love is purely spiritual (as it was for Plato), he was, throughout his career—even when he became a fiercely devout Anglican cleric writing fervid religious verse—a believer that body and soul were one in all activities, including sexual love; hence the religious imagery in "Canonization," emphasized by Cleanth Brooks, who would I think have found Targoff's analysis congenial. Her book is I would guess a model of modern literary scholarship.But here is the difference between Brooks's book, and specifically his discussion of Donne's poem, and Targoff's. Brooks, who though a distinguished Yale English professor did not have a Ph.D., wrote for a mixed audience—academics, students, the general reader—and he made the nonacademic members of that audience want to read Donne, or read more Donne, or re-read Donne with greater understanding and enjoyment. Targoff writes for other scholars of early modern English literature. Someone else who chances on the book (like me) may read it and think well of it, but unless one has esoteric religious or philosophical interests the experience of reading her book will not quicken one's [End Page 386] interest in reading Donne's poetry—which is a great shame, given the state of the literary culture... Cet article présente les résultats de l'analyse d'isotopes stables du carbone et de l'azote pratiquée sur des échantillons d'ossements humains issus des fouilles de l'habitat mésohelladique de l'Aspis. L'objectif de l'analyse est de reconstituer le régime alimentaire des habitants de l'Aspis et d'étudier les variations de régime entre des sous-groupes de population définis par des critères d'âge et de sexe et/ou de statut social. Sept échantillons ont été prélevés, dont quatre seulement ont fourni suffisamment de collagène pour être analysés. Les (...) données isotopiques indiquent que les habitants de l'Aspis avaient un régime alimentaire de type terrestre C3 relativement homogène ; toutefois, le seul individu de sexe masculin inhumé dans le cimetière semble avoir consommé plus de protéines animales (viande et/ou produits laitiers). Les ressources marines semblent avoir occupé une place négligeable dans l'alimentation des habitants de l'Aspis. D'une façon générale, le signal isotopique de leur régime alimentaire ne diffère pas fondamentalement de celui qui a été observé pour leurs contemporains de Lerne ou pour le groupe inhumé dans le Cercle Β de Mycènes. The overall objectives of this article are to help the reader see and understand through Aristotelian lenses: (1) positive and negative aspects of the Leveraged Buyout (LBO) business model; and, (2) how LBO practices can be reformed so as to retain positives and reduce negatives. Aristotelian lenses considered are: wealth acquisition through wealth expansion, wealth creation, and wealth transfers; distributive and corrective justice; and, a dialectic analytic process of retaining positives, reducing negatives, and reforming. Key net positive wealth expansion aspects (...) of the model are discussed with respect to: profitability for the owners, managers, and investors of LBO firms; potential productivity improvements on the cost and revenue sides; and, potentially greater credit availability. Negative wealth transfer and destruction aspects with respect to: a relatively high rate of bankruptcies in some countries and in economic downturns; LBO firm gains without responsibility for losses; wealth transfers from employees, creditors, ordinary vs “carried interest” taxpayers; and, damaged wealth expansion and creation capabilities of acquired organizations are discussed. Potential reforms that could reduce negatives, retain positives, and reform the model are discussed. (shrink)
